Prepare for New Requirements Under the Hazardous Waste Generator Improvements Rule

The EPA, in an effort to streamline and clarify the Resource Conservation and Recovery Act (RCRA) Hazardous Waste requirements, has enacted new generator requirements.

The 2016 Hazardous Waste Generator Improvements rule—which updated and reorganized the rules that apply to generators of hazardous waste—includes a new notification requirement taking effect in 2021 for small quantity generators (SQG) of hazardous waste.

What Is an SQG?

According to the US EPA, a generator is “any person who produces hazardous waste as listed or characterized in part 261 of title 40 of the Code of Federal Regulations (CFR).”

EPA has also established three categories of hazardous waste generators in their regulations, including:

  • Very small quantity generators
  • Small quantity generators
  • Large quantity generators

An SQG is a small quantity generator that generates between 220 and 2,200 pounds of hazardous waste in a calendar month. SQGs also generate less than 2.2 pounds of acute hazardous waste each calendar month.

What Does The New Hazardous Waste Notification Mean for My Business?

When the new notification requirement takes effect on September 1st, 2021, SQGs will be required to re-notify their generator status.

In the past, after an SQG provided initial notification in order to obtain an EPA ID number, they were no longer required to submit ongoing information about their waste activities. With this new notification requirement, SQGs will be required to re-notify once every four years. They will be able to complete the notification with a paper form (8700-12) or online through MyRCRAID—if the state where the business is located uses this system.

The new hazardous waste notification may or may not affect your SQG facility. For example, many states with SQG facilities currently require waste reporting and have already been continually filing for re-notification. Those that have not required annual waste reporting for SQGs will now require re-notification.
